The short version
- ShoutAbout is free for personal and work use, on as many of your devices as you like.
- It's provided as is, without a warranty. Speech recognition makes mistakes: check your text before you send it.
- Please don't sell it, change it and pass it on, or take it apart.
- What you say and write is yours. We never receive it.
1. Who these terms are with
These terms are an agreement between you and Spencer Seay (“we”, “us”), who makes ShoutAbout. They cover the ShoutAbout apps for Windows, iPhone and Mac (“the apps”) and this website. By installing or using the apps, you agree to them. If you don't agree, please don't use the apps.
2. Your licence
We give you a free, personal, non-exclusive, non-transferable licence to install and use the apps on devices you own or control, for personal or work use. You may share links to this website or the official app store pages.
You may not:
- sell, rent, lend or sublicense the apps, or charge others for them;
- share modified copies, or share the installer anywhere that pretends to be us;
- reverse engineer, decompile or disassemble the apps, except where the law allows it despite this term, or where an open-source licence of a part of the apps allows it;
- remove copyright, licence or trademark notices;
- use the apps to break the law, for example to record people where that needs their consent and you don't have it.
The apps stay ours. This licence doesn't give you any rights to the ShoutAbout name or the mouth logo.
3. Open-source parts
The apps include open-source software and fonts, each under its own licence, listed on the open-source licenses page and in the notices file that comes with the apps. Nothing in these terms limits the rights those licences give you for those parts. Some parts come from other companies under their own terms (for example NVIDIA's libraries in the Windows app); you may use them only as part of ShoutAbout.
4. Your words
Your recordings and the text made from them are yours. The apps process them on your own devices, and we never receive them. See the privacy policy.
5. Using it sensibly
- ShoutAbout pastes text where your cursor is. It never presses Enter or sends anything, but check the text before you do.
- Speech recognition and AI clean-up can get words wrong. Don't rely on ShoutAbout where a mistake could cause harm, such as medical, legal or safety-critical writing, without checking.
- You're responsible for the devices and networks you use it on.
6. No warranty
The apps and this website are provided free, “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent the law allows. We don't promise that the apps will be error-free, always available, or work with every device.
7. Limits on our liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost data, profits or business, arising from your use of the apps or this website. Our total liability for any claim is limited to 50 US dollars. Some places don't allow these limits, so they may not all apply to you; your rights as a consumer under the law where you live are not affected.
8. Updates and changes
We may update the apps, change what they do, or stop offering them at any time. We may also update these terms; if we do, we'll change the date at the top of this page. If you keep using the apps after a change, the new terms apply.
9. Apps from the App Store
If you got ShoutAbout from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies to the iPhone app. Apple isn't responsible for the apps or for supporting them. Beta versions you get through TestFlight are also covered by Apple's TestFlight terms, and may have more bugs than released versions.
10. Ending
You can stop using ShoutAbout any time by uninstalling it. Your licence ends automatically if you break these terms.
11. Law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, except where the law where you live says otherwise.
